European Privacy Policy

Prince respects your privacy and is committed to protecting your personal data.  This privacy policy will inform you as to how Prince protects your personal data and will also advise you about your privacy rights and how the law protects you.

OVERVIEW

In the course of its business, Prince collects and processes personal data belonging to its customers and suppliers. Prince employees (current and prospective) are subject to a separate Employee Privacy Policy.

Data Protection laws – the EU’s General Data Protection Regulations (GDPR) describe individuals who have provided personal data to an organisation (either directly or indirectly) as “data subjects”.  As a data subject, individuals have a number of rights in respect of how their personal data is processed.  All data subjects whose personal data is collected and processed by Prince can be assured that this is done so in line with the requirements of GDPR:

  • To process your data in a lawful, fair and transparent way;
  • To only collect your data for explicit and legitimate purposes;
  • To only collect data that is relevant, and limited to the purpose(s) we have told you about;
  • To ensure that your data is accurate and up to date;
  • To ensure that your data is only kept as long as necessary for the purpose(s) we have told you about; and
  • To ensure that appropriate security measures are used to protect your data

We have appointed a data protection lead who is responsible for overseeing questions in relation to this privacy notice. You have the right to make a complaint at any time to the relevant regulator for your location in Europe.  We would, however, appreciate the chance to deal with your concerns before you approach any of these organisations so please contact us in the first instance.

CHANGES TO THE PRIVACY NOTICE AND YOUR DUTY TO INFORM US OF CHANGES

This policy may need to be up-dated or changed from time to time.  You should check this page on our website to ensure that you are happy with any changes.  This policy was effective from 25 May 2018

It is also essential that the data we hold about you is accurate and up-to-date.  Please ensure that you advise us of any changes to your personal data during your relationship with us.

 COLLECTION AND STORAGE PERSONAL OF DATA

In order for Prince to supply you with goods and communications, the business needs to collect personal data for correspondence purposes and for detailed goods provision.  Prince is committed to ensuring that the information which is collected and used is appropriate for this purpose and does not constitute an invasion of your privacy.

WHAT PERSONAL DATA IS COLLECTED

The personal data or personal information which Prince collects means any information about an individual from which that person can be identified.  It does not include data where the identity has been removed (anonymous data).  Prince may collect, use, store and transfer different types of personal data and for ease these types have been grouped together as follows:

  • Identity Data includes first name, last name, username or similar identifier, marital status, title, date of birth and gender.
  • Contact Data includes billing address, delivery address, email address and telephone numbers and records of correspondence if you contact us including your email address if you email us, address if you write to us and your telephone number if you call us.
  • Financial Data includes bank account and payment card details.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

Prince employees (current and prospective) are subject to a separate Employee Privacy Policy.

HOW DO WE COLLECT THE PERSONAL DATA?

We use different methods to collect data from and about you including through:

Direct interactions:  You may give us your Identity, Contact and Financial Data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:

  • Apply for our products or services;
  • Request information from us regarding our products or services

Third parties or publicly available sources: We may receive personal data about you from various third parties:

Contact, Financial and Transaction Data from providers of technical and payment services such as credit reference agencies based in the EU.

HOW WILL THE DATA COLLECTED BE USED?

Prince will only use your personal data when the law allows us to.  Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal or regulatory obligation.

We have also identified what our legitimate interests are where appropriate. Please note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. WHO MAY HAVE ACCESS TO PERSONAL DATA?

Personal data will primarily be used by Prince employees during the course of their normal day to day activities where this is appropriate and essential for them to fulfil the needs of the business relationship which exists between us.  Prince does not sell or disclose personal data.

HOW LONG WILL YOUR PERSONAL DATA BE RETAINED?

Prince will process and store personal data for no longer than is necessary for the intended purposes for which it is collected and in line with our legal obligations.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for tax purposes.

DISCLOSURES OF YOUR PERSONAL DATA

We may have to share your personal data with the parties set out below for the purpose detailed in the above table.

Internal Third Parties:  Companies in the Prince Group , including Prince Minerals Limited, Prince Minerals GmbH, Prince Minerals Italy Srl, Prince Belgium BVBA, Prince Erachem SPRL and Prince Minerals SA Pty Ltd. as well as Prince International Corporation.

External Third Parties:  Service providers acting as processors operating in the EU, US and elsewhere who provide IT and system administration services.

Specific Categories of Third Parties such as payment service providers and courier companies.

Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets.

Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

INTERNATIONAL TRANSFERS

There may be occasions when personal data may be shared with other companies within the Prince Group.  This may involve transferring your data outside of the European Economic Area, which includes the United States of America.  We ensure your personal data is protected by requiring all companies in the Prince Group to follow the same rules when processing your personal data, providing a similar degree of protection.

DATA SECURITY

We have in place appropriate security measures to prevent your personal data from being accidently lost, used or accessed in an unauthorised way, altered or disclosed.  In addition, we limit access to your personal data to those employees and other third parties who have a business need to know.  Your personal data will only be processed on our instructions.

Any suspected personal data breaches will be dealt with using our internal procedures.  We will notify you and any applicable regulator of a breach where we are legally required to do so.

Unfortunately, the transmission of information via the internet is not completely secure.  Although we will do our best to protect your personal data, we cannot guarantee the security of data transmitted in this way.  Once we have received your information we will use strict procedures and security features to try to prevent unauthorised access.

WHAT ARE YOUR INDIVIDUAL RIGHTS?

At any time during which Prince is in possession of or process your personal data you have a number of rights:

  • Right of Access: You have the right to request a copy of information we hold about you.
  • Right of Rectification: You have a right to correct any data that we hold about you which is inaccurate or incomplete.
  • Right to be Forgotten: In certain circumstances you can ask for the data we hold about you to be erased from our records.
  • Right to restriction of processing: Where certain conditions apply, you have a right to restrict the processing of the personal data.
  • Right of portability: You have the right to have the data we hold about you to be transferred to another organisation.
  • Right to judicial review: If Prince refuses any request under rights of access, we will provide you with the reasons why and you have the right to make a complaint to the relevant regulator for your location in Europe.

WHAT HAPPENS IF YOU DO NOT WANT TO PROVIDE PERSONAL DATA OR OBJECT TO ITS PROCESSING

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods). In this case, we may have to cancel a product you have with us but we will notify you if this is the case at the time.
